CGU
These general conditions of use (hereinafter the” CGU ”) apply between TEMMOSHOTELS, a simplified joint stock company registered in the Annecy Trade and Companies Register under number 514 972 843, whose head office is at 145 avenue de l'Aiguille du Midi, 74400Chamonix-Mont-Blanc, 74400Chamonix-Mont-Blanc, (hereinafter “” TEMMOSHOTELS ”) and any user of the website accessible at https://www.aiglons.com/.
1. DEFINITIONS
Within these Terms of Use, words or expressions beginning with a capital letter have the following meaning:
· TERMS OF USE: refer to these general conditions of use of the Site;
· CGS : refer to the general terms and conditions of sale of TEMMOS HOTELS for the reservation of Services;
· Benefit (s) : Refers to all the services offered by TEMMOS HOTELS as detailed in the CGS.
· Site: refers to the website operated and published by TEMMOSHOTELS, accessible at https://www.aiglons.com/ ;
· User : refers to any person accessing and/or using all or part of the Site.
2. ACCEPTANCE OF THE GENERAL CONDITIONS OF USE
2.1 The use of the Website implies the full and complete acceptance of these T&Cs by the User. As such, the User acknowledges having fully read these Terms and Conditions and unreservedly accepting them before accessing and using the Site.
2.2 The CGU may be modified or supplemented at any time by TEMMOS HOTELS. As such, Users of the Site are invited to consult them regularly.
2.3 The Site is updated regularly by TEMMOS HOTELS. The amended T&Cs will come into force as soon as they are posted online and will therefore automatically apply.
3. BENEFITS PROVIDED
The purpose of the Site is to:
- Present the activity of TEMMOS HOTELS and the Service (s) it offers;
- Allow Users to book one or more Service (s);
- Allow Users to contact TEMMOS HOTELS, in particular in order to request a quote for additional Services (Events for example).
The various Services provided by TEMMOS HOTELS are detailed on the Website.
These Services and their characteristics may change at any time at the initiative of TEMMOS HOTELS.
4. CONDITIONS OF ACCESS AND USE OF THE SITE
The Site consists of an interface, accessible to any User accessing the Site, allowing him to consult the Services offered and to (I) book the selected Services directly online, or (II) send a request for a quotation for the Services on quotation (in particular Events).
Access to the Site is exclusively reserved for Users over 18 years of age and with the capacity to contract. Consequently, the User declares and guarantees to be at least 18 (eighteen) years old at the time of the registration request.
Access to the Site is possible twenty-four (24) hours a day, seven (7) days a week, except in the event of force majeure or an event beyond the control of TEMMOSHOTELS and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Site and related equipment.
The User can access the Site freely and free of charge, without registering or creating an account in advance. However, the costs of accessing and using the telecommunications network remain the responsibility of the User.
The Site interface allows the User to access the following sections and sub-sections:
5. OBLIGATIONS OF THE USER
5.1 The User undertakes to access and use the Site using recent equipment that does not contain viruses, and with an updated latest generation browser.
The User confirms that he has the technical knowledge necessary to ensure the correct use of the Site, in particular with regard to the manipulation of his data. The User undertakes to use the Site intelligently.
The User is solely responsible for the use of the Site. TEMMOSHOTELS cannot be held liable in this respect for a malfunction of the Site resulting in particular (i) a failure in the Internet network and/or (ii) incorrect use by the User.
5.2 Some of the information and supporting documents sent by the User as part of the use of the Site, and in particular during the reservation stages, constitute personal data, the conditions applicable to their collection and processing are defined in the Privacy Policy accessible via the following link: https://aiglons.com/politique-de-confidentialite.
5.3 The User also undertakes to provide accurate, up-to-date and complete information, not to create a false identity likely to mislead TEMMOS HOTELS or third parties and not to usurp the identity of another person.
6. SITE MAINTENANCE
At any time, the operation of the Site may be temporarily interrupted to carry out maintenance or updating operations.
As such, TEMMOS HOTELS cannot be held liable for any difficulty and/or temporary impossibility for the User to access the Site as part of said maintenance operations.
7. ADVERTISING ON THE SITE
TEMMOS HOTELS may decide at any time to place advertising spaces on its Site, and in this respect enjoys total freedom in terms of the choice of its advertisers, the types of viewing of advertisements but also their position on the Site.
8. INTELLECTUAL PROPERTY
All the elements (i) present on the Site, in particular any text, photograph, image, image, image, image, image, sound, graphic element, etc., (ii) composing the Site, including its graphic charter, its tree structure, its navigation interfaces, its databases, etc., etc., of any nature and in any form whatsoever, and (iii) any software used on the Site (hereinafter the” Properties ”) are likely to be protected under intellectual property law and to belong to TEMMOSHOTELS and/or third parties.

It is recalled that all distinctive signs, and in particular brands and logos, are and remain the property of TEMMOS HOTELS or that of the holders of the intellectual property rights concerned. Recognizing these exclusive rights to these signs, the User is prohibited from making any use of them other than that related to the consultation of the Site and from infringing the intellectual property rights of TEMMOSHOTELS or those of the holders of the rights concerned.
Any use of the Properties other than that linked to (i) the consultation of the Website or (ii) the reservation of Services is prohibited without the express, written and prior agreement of the holders of the rights concerned.
9. RESPONSIBILITY OF TEMMOS HOTELS
TEMMOS HOTELS puts in place the means and measures necessary for the smooth functioning and maintenance of the continuity and quality of the Site, and undertakes to make every effort to ensure the proper functioning of the Site and its accessibility by the User. However, the User acknowledges that TEMMOSHOTELS is only bound by an obligation of means concerning the continuity of access to the Site.
TEMMOS HOTELS cannot be held responsible for direct and indirect damage caused to the User's equipment when accessing the Site and resulting either from the use of equipment that meets the specifications indicated in Article 5 of the Terms of Use or from the appearance of a bug or incompatibility.
In general, taking into account the technical, computer and telecommunication constraints of the use of the Site, TEMMOS HOTELS cannot be held liable in the event of direct and/or indirect damage caused by a malfunction, which is not attributable to TEMMOSHOTELS and/or difficulty in accessing one or more of the stages of booking Services on the Site, due in particular to the disadvantages inherent in the use of the Internet network, such as a break in service or the presence of of computer viruses.
10. HYPERTEXT LINKS
Hypertext links to third party websites may be communicated by TEMMOS HOTELS via the Website. TEMMOS HOTELS disclaims any responsibility in the event that the content of these third party websites violates the legal and regulatory provisions in force.
11. VARIOUS PROVISIONS
11.1 The fact that a party does not rely on a stipulation of the T&Cs does not in any way constitute a waiver of the benefit of this clause.
11.2 The nullity, unenforceability or, more generally, the absence of effect of any of the provisions of the CGU will not affect the rest of the CGU and these will be executed as if this stipulation had never existed provided, however, that this did not compromise the balance of the CGU and that the stipulation in question was not a determining condition of the consent of a party. In addition, the parties agree to replace, as far as possible, any ineffective stipulation by a valid stipulation having the same effect and reflecting, as far as possible, their initial will.
11.3 The parties declare that they have full capacity and have no legal, contractual or judicial impediment to the acceptance of the T&Cs.
12. APPLICABLE LAW AND ATTRIBUTION OF JURISDICTION
Any dispute in connection with all or part of the stipulations provided for in these T&Cs is subject to French law.
Except in cases where the Law does not allow it, exclusive jurisdiction is granted to the competent courts of Paris.
CGS
These general conditions of service (hereinafter the” CGS ”) apply between TEMMOS HOTELS, a simplified joint stock company registered in the Annecy Trade and Companies Register under number 514972 843, whose head office is at 145 avenue de l'Aiguille du Midi, 74400 Chamonix-Mont-Blanc, 74400 Chamonix-Mont-Blanc, (hereinafter “” TEMMOS HOTELS ”) and any TEMMOS HOTELS Customer.
1. DEFINITIONS
● Customer (s) : Refers to professional customers or consumers subscribing to the Services offered by TEMMOS HOTELS.
● Establishment : refers to the establishment operated by TEMMOS HOTELS located at 270 Avenue de Courmayeur, 74400 Chamonix-Mont-Blanc.
● Part (s): Refers to TEMMOS HOTELS and/or the Customer.
● Service (s): Refers to all the services offered by TEMMOS HOTELS and described in Article 3 of the CGS:
● Web site: Refers to the website accessible at the following address: https://www.aiglons.com/.
2. GENERALITIES
3. These CGS are applicable to all bookings of Services by the Customer via the Website, by email, directly to the Establishment or by telephone.
2.1. Some provisions of the CGS may vary depending on the Customer's professional or consumer status.
The consumer Customer declares that he is acting for personal purposes, outside the framework of his commercial, industrial, artisanal, liberal or agricultural activity, and to have full legal capacity allowing him to commit himself under these GCS.
The Customer declares that he is of legal age.
TEMMOS HOTELS therefore reserves the right not to respond to bookings from Customers who do not meet the above conditions.
2.2. The CGS apply to the exclusion of all other conditions. They are communicated to the Customer before any reservation and take precedence, where applicable, over any other version or any other document.
The Customer acknowledges that the validation of the reservation implies adherence to these GCS.
2.3. These T&Cs may be modified by TEMMOSHOTELS at any time and without notice. Each Customer is therefore invited to regularly consult the latest updated version of the CGS, available to all and permanently accessible on the Website, and in particular during each reservation. The amended CGS will come into force as soon as they are posted online and will therefore automatically apply.

The fact of making a reservation after any modification made to the CGS will constitute acceptance of these changes by the Customer. In any event, the Customer's refusal of the new CGS must be express and unequivocal. Where applicable, the Customer will be deemed to have accepted the new CGS. If the Customer refuses to comply with any of the obligations and conditions contained in these GCS, he is invited not to make a reservation.
3. DESCRIPTION OF BENEFITS
TEMMOS HOTELS offers various Services on its Website, including the reservation of rooms and catering offers, as well as additional Services.
3.1. Accommodation service
TEMMOS HOTELS offers several rooms (classic, superior or suite), with an area ranging from 20m2 to 45m2, within the Establishment (classic, superior or suite).
The characteristics of the rooms offered, the available facilities, the dates of availability, the price as well as additional options, cancellation conditions or special conditions of eligibility are detailed in these CGS and on the Website.
The Customer acknowledges that the photographs on the Website do not constitute a contractual document; as such, the Customer will not be able to take advantage of any variation in the rooms compared to the photographs published on the Website.
3.2. Additional benefits
TEMMOS HOTELS offers for booking various Services that are complementary to or independent of the Accommodation Services:
- Treatment in the SPA located within the Establishment. The SPA includes a swimming pool, a hot tub, a sauna and a steam room and offers a number of services (massage, manicure, facial treatments, etc.). It is open every day from 10 a.m. to 12 p.m. and from 2 p.m. to 8 p.m. The treatment is booked directly on the dedicated site;
- Catering offer at the CASA NONNA restaurant located within the Establishment. The reservation can be for breakfast (open from 6:30 to 10:00), lunch (12:00 to 14:00) and/or dinner (from 19:00 to 22:00). The restaurant also has a bar area open from 12:00 to 23:00. The reservation is made directly on the dedicated site;
- Supplements : the supplements are indicated on the Website and include in particular a baby bed, the presence of a pet (within the limit of two animals per room), a parking space for a vehicle, etc. These supplements may be subject to pricing conditions.
- Partner services : partner services are offered by TEMMOS HOTELS Partners and include in particular entertainment activities (karaoke activity via BAM KARAOKE) or the rental of ski equipment and accessories (via MILLET, SKIMIUM and SANGLARD) .Partner services are booked directly on the Partner's website.
3.3. Packages
TEMMOS HOTELS offers various formulas including one or more Additional Services associated with the reservation of an Accommodation Service:
- Chamonix discovery package : this offer includes breakfast or half-board (depending on the formula chosen), the ski pass, and for any stay of at least three nights, access to the covered and outdoor skating rinks, the Chamonix swimming pool, the Alpine Museum, the Alpine Museum, the Mountain Museum, the Mountain Museum, the Mountain Museum, the Mountain Museum, the Maison de l'Alpage, the Espace Forme and the Espace Tairraz;
- Wellness package : this offer includes half-board with the possibility of healthy meals, a 45-minute massage per day per person for the duration of the stay, unlimited access to the SPA (swimming pool, sauna, steam room) and a 10% discount on Deep Nature SkinCare products (sold on site);
- Snow package : this offer includes the ski pass and the equipment for skiing, snowboarding or snowshoeing.
3.4. Events
Several areas of the Establishment can be reserved by the Customer for group events (seminar, meeting, association, works council, conference, etc.) in addition to the Accommodation Services.
The characteristics of the areas that can be privatized, as well as the reservation conditions and associated prices, are specified on the Website.
These Services are the subject of an estimate by TEMMOS HOTELS.
4. RÉENTITLEMENT
The reservation can be made:
- by phone at the following number: +33 (0) 4 5055 90 93;
- by email to the following addresses: reservation@hotelaiglonschamonix.com or reservation.aiglons@temmos.eu;
- directly at the Establishment;
- on the Website.
4.1. Stages of the reservation made on the Website
4.1.1. Booking the Accommodation Service/Additional Services/Package
Step 1 : The Customer surrenders (i) either in the “MENU”, and click on the “ROOMS” tab, then choose one of the proposed Rooms by clicking on “BOOK”, (ii) either directly in the “BOOK” tab then click on “ONE ROOM”, (iii) or on the home page.
Step 2 : The Customer provides the following information:
- Number of adults;
- Number of children;
- Children's age;
- Desired dates of stay (arrival and departure).
Step 3 : Depending on the selection made and availability, one or more rooms and, if applicable, one or more Packages, are offered to the Customer.
It is specified that the Chamonix Discovery Package and the Snow Package must be booked at least 7 days before the arrival date.
The Customer also has the option of selecting various Additional Services (excluding Supplements).
Once the options have been selected, the Customer clicks on “BOOK”.
Step 4 : The Customer can select one or more Supplements by clicking on “ADD”. Otherwise, he clicks on “CONTINUE” in order to continue with the reservation.
Step 5 : A summary of the reservation is presented to the Customer before validation, specifying the total duration of the stay, the date and time of arrival and departure, the room (s) reserved, the number of adults and children, the rate applicable to each Service, the rate applicable to each Service, any Packages and Additional Services selected, as well as the taxes and fees, and the total amount of the reservation.
The Customer undertakes to check that the summary corresponds to the reservation he wishes to make before validating his reservation. Otherwise, he can modify it in whole or in part and a new summary will be submitted to him.
Step 6 : The Customer enters his personal information, his billing details and indicates the time of his arrival. In case of automatic entry, the Customer is invited to check the accuracy of his contact details before confirming the reservation.
Step 7 : By validating the reservation on the Website, the Customer declares to have read and accepted these CGS. The validation of the reservation implies acceptance of the CGS, the price and the characteristics of the reservation made.
4.1.2. Event Booking:
- Step 1 : The Customer surrenders (i) either in the “MENU” and click on the “SEMINAR” tab, then on “REQUEST A QUOTE”, (ii) or directly in the “BOOK” tab then click on “GROUP AND PRIVATIZATION”.
- Step 2: The Customer provides several information relating in particular to the type of group (associative, sport, company), the desired dates of stay, the number of participants, the distribution of participants as well as their age. Once the selection is made, the Customer clicks on “CONTINUE”.
Step 3 : The Customer specifies the desired level of comfort, the budget per night, the catering needs as well as the spaces desired for privatization. The Customer continues with the Booking by clicking on “CONTINUE”.
- Step 4: The Customer enters his email address so that he can be sent a quote, and clicks on “CONTINUE”.
- Step 5: The Customer then enters several pieces of information relating to the entity requesting a quote and contact details, and then clicks on “SEND MY REQUEST FOR A QUOTE”.
4.2. Stages of the reservation made by phone /on quotation
In the event of a reservation by telephone, TEMMOS HOTELS sends an email taking into account the reservation with the characteristics of the Services and these CGS, prior to the confirmation of the reservation by the Customer.
The Customer undertakes to check that the summary corresponds to the reservation he wishes to make. In this case, the Customer is invited to click on the link integrated into the email in order to pay the price of the Service via the Website. Payment can also be made by telephone.
In the event of a reservation for an Event, TEMMOS HOTELS sends an email taking into account the request specifying the characteristics of the Services booked, the agreed billing methods and these CGS. In case of acceptance of the quotation by the Customer, which can be made by returning an email or telephone, TEMMOSHOTELS will send the Customer a link by email in order to allow him to pay the agreed price.
4.3. Confirmation of the reservation
Once the reservation has been validated and paid, regardless of the method of payment, a confirmation email will be sent to the Customer at the email address indicated by the Customer. This confirmation email will detail the summary of the reservation, including the reference and the details of the reservation. All the information in this reservation confirmation email will be deemed to constitute the agreement between the Customer and TEMMOS HOTELS.
TEMMOS HOTELS reserves the right not to confirm the reservation, in particular in the event of refusal of payment authorization or any other difficulty observed. The Customer will be informed of the refusal of payment directly on the Website.
It is the Customer's responsibility to keep the contractual information provided in the confirmation email on the medium of his choice.
5. PRICE AND PAYMENT
The prices relating to the reservation of the Services are indicated before, during and after the reservation. Prices vary according to the date and time of reservation.
The prices shown are net per stay for two adults. When confirming the reservation of an accommodation, the total price is indicated to the Customer in the amount of VAT in euros and is only valid for the duration indicated on the Website. Unless otherwise stated on the Website, additional Services (for example, catering, activities, etc.) that are not selected when the Service is booked are not included in the price.
In general, prices do not include all personal or incidental expenses in the room, such as civil protection insurance, laundry expenses, telephone expenses, drinks, room service, tips and more generally any service not expressly included in the booking confirmation.
The tourist tax is payable directly on site to TEMMOS HOTELS.
The prices take into account the VAT applicable on the day of the reservation and any change in the applicable VAT rate will automatically be reflected in the price indicated on the billing date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the price indicated on the date of the invoice. Finally, some promotional offers are only available on the Website and in no case at the establishment's reception.
The payment of the Services will be made as follows:
- Flexible rate (reservation of cancellable/refundable Services): the Customer will pay 30% of the total price when booking (corresponding to the reservation of the Room, breakfast and dinner in case of half-board). The remaining balance, as well as any Supplements, are paid at the establishment's reception during or at the end of the stay;
- Reduced rate (reservation of non-cancellable/non-modifiable/non-refundable Services): the Customer will pay 100% of the price when booking. Any Supplements are paid at the reception of the Establishment during or at the end of the stay;
- Packages : the Customer will pay 100% of the price when booking;
- Events : a first deposit will be requested from the Customer after validation of the quote. The remaining balance due will be paid at the establishment's reception during or at the end of the stay.
6. PAYMENT METHODS
Payment can be made by credit card CB, Visa, Mastercard, Mastercard, American Express, by Apple Pay or by holiday vouchers (excluding payment made directly on the Website or by telephone).
During the validation of the payment, the Customer undertakes to provide accurate and up-to-date information and to inform TEMMOS HOTELS of any change in his bank details. The Customer is informed that payment may be refused if the bank card used has expired, if the maximum amount of expenditure has been reached or if the information entered is incorrect.
TEMMOS HOTELS may also refuse or cancel any reservation when (I) the banking information provided by the Customer is erroneous, expired or usurped and/or (II) there is a dispute with the Customer concerning the payment of a previous reservation. As such, the Customer may be asked to present an identity document for the purposes of preventing bank card fraud.
TEMMOS HOTELS cannot under any circumstances be held responsible for any fraudulent use of the bank card used to pay for the reservation by the Customer.
TEMMOS HOTELS will record an imprint on the Customer's credit card upon arrival as a guarantee for the total amount of Services and Additional Services booked during the stay and/or to cover any damage caused by the Customer. TEMMOS HOTELS also reserves the right to request a deposit of €200. As such, the Customer undertakes to sign any document authorizing TEMMOS HOTELS to debit his bank card.
7. CANCELLATION OR MODIFICATION OF THE RESERVATION
7.1. Cancellation of the reservation by the Customer
It is recalled that the right of withdrawal provided for in article L 221-18 of the Consumer Code does not apply to Services in accordance with article L 221-28 12° of the Consumer Code.
The conditions for cancelling and modifying the booked Service are specified on the Website when the Service is booked.
If the Customer has opted for a “flexible” rate, the Customer may cancel the Service (s) up to fifteen (15) days before the date reserved for the Service free of charge. In this case, the total amount of the Service will be paid by the Customer. In case of cancellation within the above deadlines, the amounts will be returned to the Customer within a period of (x) days [BSF1] .
If the Customer has opted for a “reduced” rate, the price of the Services will be charged as soon as the reservation is made and cannot be subject to any refund in the event of cancellation, all amounts paid by the Customer being retained by TEMMOS HOTELS as a deposit within the meaning of articles 1590 of the Civil Code and L. 214-1 of the Consumer Code. The deposit will not be refunded and corresponds to the total amount indicated when booking and, where applicable, the price of the Additional Services selected by the Customer.
7.2. Cancellation of the reservation by TEMMOS HOTELS
TEMMOS HOTELS reserves the right to cancel any reservation made by the Customer who does not meet the conditions specified in article 2 and/or refuse access to the Establishment.
Cancellation does not result in any refund of amounts that have already been paid.
8. CLAIMS
The Customer may choose to benefit from a mediation service that is completely free of charge. The Customer may use it for any disputes that may arise concerning the reservation in the event that no solution has been found.
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, TEMMOS HOTELS adheres to the Tourism and Travel Mediator Service. After prior written notification by consumers to TEMMOSHOTELS, the Mediator Service may be contacted for any consumer dispute whose settlement has not been successful. However, both the Customer and TEMMOS HOTELS remain free to accept or refuse this amicable recourse to mediation.
In addition, for all practical purposes, in accordance with article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an online dispute resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. 9. GUARANTEES AND LIABILITY
9.1. Responsibility of TEMMOS HOTELS
9.1.1. TEMMOS HOTELS cannot be held liable in the event that the non-execution or poor performance of its obligations (such as in particular, but not exclusively, any malfunction and/or any interruption in the provision of the Services), is attributable to (i) either to the behavior of the Customer, (ii)or to the unforeseeable and insurmountable fact of a third party, (iii) or to a case of force majeure as defined by the regulations in force and interpreted by the French courts.
In addition, in the event of an error in entering the email address concerned, or non-receipt of the electronic message confirming the reservation, TEMMOS HOTELS cannot be held liable. In this case, the reservation will be considered final, except in cases of cancellation of the reservation by TEMMOS HOTELS.
9.1.2. Hypertext links to third party websites may be communicated by TEMMOS HOTELS via the Website. TEMMOS HOTELS disclaims any responsibility in the event that the content of these third party websites violates the legal and regulatory provisions in force.
9.2. Customer Responsibility
9.2.1. During their stay, the Customer is responsible for the room and the equipment made available to them.
9.2.2. In the event of undeclared damage or deterioration of the room and/or spaces and/or equipment before the Customer's departure, TEMMOS HOTELS reserves the right to deduct the amount necessary to restore said goods as well as any ancillary costs related to the immobilization of the room and/or equipment during this period.
9.2.3. The Customer undertakes to respect the special conditions applicable within the Establishment. In particular, he must wear adequate and correct clothing at all times, and behave appropriately towards the staff of the Establishment and other customers.
The Customer also undertakes to ensure that the computer resources made available to him by the hotel (in particular the WiFi network) are not used in any way for illegal purposes. The Customer must accept the security and use of computer resources policy prior to any use.
9.2.4. The Customer must not smoke in the Establishment, the rooms and the restaurant. It must under no circumstances interfere with the proper functioning of the Establishment or compromise the safety of the Establishment or of persons.
In general, the Customer must behave correctly at all times and is prohibited from engaging in any behavior contrary to morality and public order, or contrary to the applicable Internal Regulations, if applicable. Otherwise, the management of TEMMOS HOTELS or any authorized person may ask the Customer to leave the Establishment without any compensation being due, or any reimbursement made.
10. VARIOUS PROVISIONS
The Contract between the Customer and TEMMOS HOTELS and/or its successors and assigns is binding between the Parties. The Contract, the rights and obligations of the Parties may not be assigned or transferred without the prior written consent of the other Party.
The fact that a Party does not rely on a provision of the CGS does not in any way constitute a waiver of the benefit of this clause.
The Parties undertake, in general and for the entire duration of the Contract, to always behave towards each other as loyal and good faith partners, and in particular to immediately report any difficulty they may encounter in the context of the execution of the Contract.
The nullity, unenforceability or, more generally, the absence of effect of any of the provisions of the CGS will not affect the rest of the CGS and these will be executed as if this stipulation had never existed provided, however, that this did not compromise the balance of the Contract and that the stipulation in question was not a determining condition of the consent of a Party. In addition, the Parties agree to replace, as far as possible, any ineffective stipulation by a valid stipulation having the same effect and reflecting, as far as possible, their initial will.
11. APPLICABLE LAW/COMPETENT COURTS
The CGS are subject to French law and French standards in force.
Except in cases where the Law does not allow it, exclusive jurisdiction is granted to the competent courts of Paris.
