The use of the Site and the reservation of Services offered by TEMMOS HOTELS result in the processing by TEMMOS HOTELS, and where applicable its partners, of personal data.
This privacy policy (hereinafter the” Confidentiality policy ”) aims to inform you about how TEMMOS HOTELS collects, uses and protects your personal data and the means at your disposal to control this use.
The Privacy Policy is an integral part of the General Terms of Services (” CGS ”) and the General Terms of Use (” CGU ”) of the Site. As such, all capitalized terms have the same definition as that given to them in the CGS and CGU and this Article 1.

●” User (s) ” :refers to any person accessing and/or using all or part of the Site.
2. NATURE OF THE PERSONAL DATA PROCESSED
The use of the Website may result in the collection and processing of Personal Data, which is carried out in compliance with the Applicable Regulations.
Personal Data collected and processed by TEMMOS HOTELS in connection with the use of the Website is strictly confidential. The categories of Data that may be collected by TEMMOS HOTELS are as follows:

● Data communicated by the Customer to TEMMOS HOTELS as part of exchanges relating to Customer relations and after-sales service.

o Payment type used;
o Payment reference.
● Data communicated to Partners when the User accesses their site via the Website.
● Usage Data.

4. PURPOSES OF DATA COLLECTION
The Data collected will be processed by TEMMOS HOTELS in order to:
● Allow TEMMOS HOTELS to register the Customer's Booking request;
● Allow TEMMOS HOTELS to manage Bookings and monitor the Customer relationship (reservation confirmation, reservation reminders, after-sales service, etc.);
● Process the payment made by the Customer, make any refunds;
● Allow TEMMOS HOTELS to create accounting documents and supporting documents in order to comply with certain legal obligations;
● Process requests for information sent by the User and/or the Customer via the contact form;
● Send information and/or commercial offers from TEMMOS HOTELS subject to the express and prior agreement of the User and/or the Customer;
● To produce statistics that will be used by TEMMOS HOTELS, in particular for the improvement of its Site, and/or transmitted to third parties after anonymization;
● Improve and personalize the Website, ensure its security.
5. LEGAL BASES FOR THE PROCESSING OF PERSONAL DATA
The processing of Data carried out by TEMMOS HOTELS is based on several legal bases in application of article 6 of the RGPD.
(i) Article 6.1 b. of the RGPD : The processing is necessary for the execution of a contract to which the Data Subject is a party or for the execution of pre-contractual measures taken at the request of the Data Subject (Customer relationship management, in particular sending a reservation confirmation email after payment and acceptance of the CGS);
(ii) Article 6 1 c. of the RGPD : The processing is necessary for compliance with an obligation to which the Data Controller is subject (in particular articles L. 123-22 of the Commercial Code, article L. 34-1 of the Postal and Electronic Communications Code) — (Establishment of accounting documents and documents);
(iii) Article 6 1 a of the RGPD: The Data Subject has consented to the processing of their Data for one or more specific purposes (Communication of commercial offers after acceptance by the Person Concerned, Audience data when the Data Subject has consented to the cookie management policy);
(iv) Article 6 1 f. of the RGPD : The Processing is necessary for the purposes of the legitimate interests pursued by the Data Controller (After-sales follow-up).
6. RIGHTS OF THE PERSONS CONCERNED
6.1. Information
In accordance with the Applicable Regulations, the Data Subject has the right to exercise the following rights with TEMMOS HOTELS:
● the right to access, rectify and/or delete their Data;
● the right to oppose the processing of its Data, to request the limitation of the processing of the Data;
● the right to request the portability of your Data;
● the right to withdraw or modify one's consent to the collection and processing of one's Data;
TEMMOS HOTELS undertakes to notify any Data breach likely to generate a high risk for the rights and freedoms of Data Subjects and to the competent supervisory authority (CNI Len France).
6.2. Exercise
The rights referred to in Article 6.1 above may be exercised with TEMMOS HOTELS by writing to it by email to the email address indicated in Article 3.
The Data Subject who makes the request must prove his identity by indicating his name, first name and email address.
In the event of an absence of response the month following the request (the duration may be extended to three months for a complex request) or an unsatisfactory response, the Person Concerned has the option of contacting the CNIL (www.cnil.fr).
7. DATA RECIPIENTS
Personal Data is intended to:
● TEMMOS HOTELS and more particularly to staff authorized by reason of their mission (commercial department, customer service, legal department, etc.);
● Authorized subcontractors and service providers of TEMMOS HOTELS (Partners in particular), it being specified that the contract signed between these subcontractors/service providers and TEMMOS HOTELS mentions the Data protection obligations entrusted to it.
Data may also be made available to the competent public authorities when required by law or upon request.
The updated list of TEMMOS HOTELS subcontractors and service providers can be requested at any time from TEMMOS HOTELS.
8. DATA TRANSFERS
8.1. Generalities
Data transmitted to external service providers or partners of TEMMOS HOTELS process this Data:
(i) Either as a data controller (in particular banks, etc.), for the purposes of managing Users' access to the Services, or;
(ii) Or as subcontractors (in particular hosts, payment providers, payment providers, carriers, communication agencies, Google Analytics, Google Ads, Facebook, etc.).
The contract signed between the service providers and/or external partners and TEMMOS HOTELS mentions the Data protection obligations entrusted to them.
Data may be transferred and processed outside the European Union, in particular to ensure the hosting of the Data or in the event of exploitation of the Data on social networks.
In this case, and prior to any transfer, TEMMOS HOTELS ensures the security of the transfer of this Data. In the event that the legislation of the country concerned by the transfer of Data has not been recognized as presenting an adequate level of data protection, TEMMOSHOTELS undertakes to ensure that the necessary measures are put in place in accordance with the Applicable Regulations (cross-border flow agreements in accordance with the standard contractual clauses issued by the European Commission).
9. METHOD AND SECURITY OF PERSONAL DATA PROCESSING
TEMMOS HOTELS processes the Data collected with all required precautions and takes all necessary security measures to prevent unauthorized access, disclosure, modification or destruction of the Data. As such, Data processing is carried out using computers or computer tools and by following procedures and organizational methods closely related to the purposes of the processing indicated.
The User is informed that the Data relating to his bank details are processed securely on behalf of TEMMOS HOTELS by its provider PLANET PAYMENT, a recognized international security standard.
10. DATA RETENTION PERIOD
In accordance with the Applicable Regulations, the Data processed is kept in an active database for the time necessary to achieve the purposes for which they were collected, and in general, for as long as necessary to:
● the management of the processing of the Reservation (placing the Reservation, after-sales service, complaints, refunds, etc.);
● the communication of information and/or commercial offers from TEMMOS HOTELS, if the Customer has given his express and prior agreement;
● the purging of the legal conservation obligations incumbent on TEMMOS HOTELS;
● the production of statistics that will be used by TEMMOS HOTELS, in particular for the improvement of its Website, and/or transmitted to third parties.
After five (5) years of inactivity on the Website, the Data is automatically purged to keep only pseudonymized and/or anonymized data, in compliance with the legal, accounting and fiscal obligations incumbent on TEMMOS HOTELS.
In order to resolve conflicts, to prevent fraud, abuse, to apply the CGS and/or to comply with legal obligations, TEMMOS HOTELS reserves the right, in compliance with legal and regulatory requirements, to keep some of the Data processed for a limited period of time, even if they are no longer necessary for the Reservation (for example, Billing Data is kept for 10 (ten) years in intermediate archiving pursuant to article L121.2. 3-22 of the Commercial Code).
In any event, except for exceptions related to TEMMOSHOTELS' legal obligations, the period of storage of Personal Data will not exceed the duration of five (5) in an active database followed by (2) years in intermediate archiving in a pseudonymized form.
11. GENERAL INFORMATION
11.1. Legal action
The Personal Data collected may be used for legal purposes by the Data Controller, in court or at any stage leading to possible legal action resulting from an inappropriate use of the Website or related services.
The Data Subject is aware that public authorities may require the Data Controller to disclose their Personal Data.
11.2. System log and maintenance
For operation and maintenance purposes, the Website may collect files that record interactions with the said Website (system log) or use any Personal Data (such as IP address) for this purpose.
11.3. Information not included in this Privacy Policy
More information concerning the collection or processing of Personal Data may be requested from TEMMOS HOTELS at any time.
11.4. Modification of the Privacy Policy
TEMMOS HOTELS reserves the right to modify or rectify this Privacy Policy at any time. The User is invited to regularly consult this page to obtain the date of last modification indicated at the top of this page and to obtain the most recent information on TEMMOS HOTELs' privacy practices.
If a User objects to any modification made to this Privacy Policy, the User must stop using the Website and may ask TEMMOS HOTELS to delete the Personal Data concerning him under the conditions of Article 6 hereof.
